Sacred Stock Standard License

This license agreement ("Agreement") is a legal agreement between you ("Licensee") and Sacred Stock ("Licensor") for the use of photos, graphics, and videos ("Content") available on the Sacred Stock platform. By downloading or using any Content from Sacred Stock, you agree to be bound by the terms of this Agreement.

1. License Grant

Subject to the terms of this Agreement, Sacred Stock grants you a non-exclusive, worldwide, perpetual license to use the Content for both personal and commercial purposes. This license is granted upon download of the Content through a valid Sacred Stock subscription or as otherwise authorized.

2. Permitted Uses

Under the Standard License, you are permitted to:

  • Digital Use: Use Content in websites, blogs, social media posts, digital advertisements, email marketing campaigns, mobile applications, and other digital media.
  • Print Use: Use Content in printed materials such as brochures, flyers, posters, magazines, newspapers, books, packaging, and other physical media.
  • Commercial Projects: Use Content in commercial projects including marketing materials, product packaging, presentations, and advertising campaigns.
  • Editorial Use: Use Content for editorial purposes in news articles, documentaries, educational materials, and informational content.
  • Personal Use: Use Content for personal projects, home decor, gifts, and non-commercial creative endeavors.
  • Broadcast and Film: Use Content in video productions, films, television programs, streaming content, and multimedia presentations.
  • Merchandise (Limited): Use Content as part of a larger design in merchandise, but not as the primary element of the product for resale.

3. Restrictions

The following uses are NOT permitted under any Sacred Stock license:

  • Redistribution: You may not redistribute, resell, lease, license, or sub-license the Content to third parties, whether in its original form or as a derivative work.
  • Standalone Resale: You may not sell, license, or distribute the Content as standalone files, digital downloads, or stock media.
  • Trademark Use: You may not use the Content as part of a trademark, service mark, or logo without significant modification.
  • Sensitive Content: You may not use Content depicting identifiable people in connection with sensitive subjects such as mental health, crime, violence, sexual content, or political endorsements without proper model releases.
  • Defamatory Use: You may not use Content in a way that is pornographic, defamatory, fraudulent, illegal, or that promotes hatred, discrimination, or harm.
  • AI Training: You may not use Content for machine learning, artificial intelligence training, or similar automated data extraction purposes without explicit written permission.
  • NFT Creation: You may not use Content to create Non-Fungible Tokens (NFTs) or similar blockchain-based assets for sale.
  • Print-on-Demand (Primary Element): You may not use Content as the primary element of print-on-demand products where the Content is the main value of the product.

4. Attribution

Attribution is not required but is always appreciated. If you choose to provide attribution, please credit Sacred Stock and, where possible, the original contributor. Suggested format: "Photo/Video/Graphic by [Contributor Name] on Sacred Stock"

5. Model and Property Releases

Content depicting identifiable people may or may not have model releases on file. It is the Licensee's responsibility to determine if additional releases are required for their specific use case, particularly for commercial or sensitive applications. Sacred Stock makes no guarantees regarding the availability of model or property releases.

6. Intellectual Property

All Content remains the intellectual property of Sacred Stock and/or its contributors. This license grants you usage rights only; no ownership or copyright is transferred. You may not claim authorship of the Content or register the Content as your own intellectual property.

7. Warranty Disclaimer

THE CONTENT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. SACRED STOCK DOES NOT WARRANT THAT THE CONTENT WILL MEET YOUR REQUIREMENTS OR THAT USE WILL BE UNINTERRUPTED OR ERROR-FREE.

8. Limitation of Liability

IN NO EVENT SHALL SACRED STOCK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THIS LICENSE OR THE USE OF THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

This license is effective until terminated. Sacred Stock may terminate this license at any time if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Content and destroy all copies in your possession or control. Termination does not affect any rights that have vested prior to the termination date.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sacred Stock, its officers, directors, employees, and contributors from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Content or any breach of this Agreement.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Sacred Stock operates, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved in the courts of competent jurisdiction.

12. Modifications

Sacred Stock reserves the right to modify the terms of this license at any time. Changes will be posted on our website and will be effective immediately upon posting. Your continued use of the Content after any changes constitutes acceptance of the new terms.
